The purpose of this web page is to bring to the attention of Yukon government employees notices of the right to appeal.
Notice of Right to Appeal
The right to appeal staffing decisions flow from Article 46 of the Yukon government/PSAC Collective Agreement [799.16 KB
] and Section 99 of the Public Service Act [1071.69 KB].
Only bargaining unit members may appeal under Article 46 of the Collective Agreement and only for regular indeterminate or term positions.
An appeal pursuant to Section 99 is for managerial or confidential positions.
In situations where a competitive process has taken place, the right to appeal is communicated directly to the employee, either verbally or in writing.
There are two circumstances however where this right is communicated in a different manner.
- The first is in the case of an exemption and
- the second is in the case of an eligibility list appointment.
