Exemption and Eligibility List PostingsThe purpose of this web page is to bring to the attention of Yukon government employees notices of the right to appeal. Notice of Right to AppealThe right to appeal staffing decisions flow from Article 46 of the Yukon government/PSAC Collective Agreement [799.16 KB Only bargaining unit members may appeal under Article 46 of the Collective Agreement and only for regular indeterminate or term positions. An appeal pursuant to Section 99 is for managerial or confidential positions. In situations where a competitive process has taken place, the right to appeal is communicated directly to the employee, either verbally or in writing. There are two circumstances however where this right is communicated in a different manner. The first is in the case of an exemption and the second is in the case of an eligibility list appointment. Exemptions An exemption is an appointment without competition of a person to a term or indeterminate position. Exemptions are made in very specific and exceptional situations when it is determined that it is in the best interests of the Public Service to do so. Any employee, other than a casual, may appeal the appointment if he/she feels that his/her promotional opportunities have been prejudicially affected. A notice of right to appeal an exemption is posted on bulletin boards throughout government departments. As well, it is posted on this website.
Eligibility lists are established through the competitive process. They include all candidates who are certified in a competition. They are used to staff identical vacant positions in the same department and location. Job offers from eligibility lists are appointments to positions, and where the vacancy is a regular position in the bargaining unit, appeal rights are available to any bargaining unit candidate who was screened in on the competition, whether certified or not. A notice of the right to appeal an eligibility list appointment will be communicated directly to the candidates or where that is not practical, it is posted on this web site.
